Planning Commission approves fireworks stand, subdivision to reapply

The Smithfield Planning Commission approved recommendations for a staging area for A&D Landscaping and a fireworks stand at Lee’s Marketplace. They also listened to concerns over the Park Place subdivision which was requesting to move to stage two of their division.

Linda Gittins read a statement to the Planning Commission when they were discussing the Park Place subdivision. In it she asked the commission to compare the plat approved by the commission with the plat sent in to UDOT for access from State Highway 218. Specifically Gittins stated that she thought UDOT should install left-hand turn lanes because of the higher traffic expected because of the new school. She also pointed out that the preliminary plat permit had expired.

The commission did find that the plat application had expired and would need to be resubmitted to the planning commission next month. UDOT, however, is a separate matter from the planning commission and is probably not something UDOT would need to reconsider.

The subdivision is required to have two entrances because they exceeded the minimum number of homes for one entrance. The subdivision has both entrances, the main entrance on the south from Highway 218 and the second entrance from 800 W which runs by the new elementary school. They do not need additional entrances to the subdivision so UDOT will not require any further consideration for this subdivision.

A&D Landscaping

Jared Gillman of A&D Landscaping came to address two issues with the commission. The first was the placement of a shed on their property at 500 South and 100 West. Gillman said at first the shed was placed near the fence. However, once they became aware that the shed was supposed to be 30 feet set back from their property line, they moved it — 32 feet — to ensure they were in compliance.

A couple from the Autumn Retirement Community expressed their concern that the shed was still an eyesore and asked that it be moved further. The commission members pointed out that Gillman was in compliance with the law and was not required to move it. However, they could ask Gillman to move it as a favor which Gillman replied that they were happy to do it and would move the shed further down the property line.

It was also pointed out that all the land in that area is zoned for manufacturing and the shed is only the first of many, much larger manufacturing buildings that are expected to be constructed in the area.

Gillman also asked for a conditional use permit for the old red brick building at 521 South Main to be used as a staging area for their landscaping business. He said they would have some office staff there full time, however, most of their workers would be out during the day. Only about 8 cars should be present during the day and they would store their company trucks there at night.

TNT Fireworks

In the past, Lee’s Marketplace had manned a fireworks stand in their parking lot. This year, Lee’s is not planning to be involved in running the fireworks stand. American Promotional (DBA TNT Fireworks) asked the commission to allow them to run the fireworks stand. They would lease the space from Lee’s but would run it with their own staff. The commission approved their conditional use permit.

Monte Vista

No representative from JEF Investments LLC came to discuss the commercial subdivision of Monte Vista at 531 South Main. The commission did open the public hearing. Bryant McKay asked about their request to waive the sidewalk requirement. Councilman Brent Buttars talked about the requirements for lawns, trees and parking.

Because no representative came to the meeting, the commission tabled further deliberation until the next meeting.
